Website Care Package Terms

The Agreement

These terms describe the Founding Client Website Care Package (the "Package") provided by ByteBuilder Technologies, LLC ("ByteBuilder," "we," "us") to Painting With A Smile ("Client," "you"). The Package combines one-time onboarding services (website design and launch, domain/DNS migration, and Google Business Profile setup assistance) with recurring monthly services (hosting, maintenance, contact-form delivery, and minor updates).

Website Design & Launch (One-Time — Fee Waived)

The Package includes the setup and launch of a professionally redesigned business website — as delivered and previewed, comprising twelve (12) standard informational pages — including:

• Mobile-friendly, responsive design
• Modernized page layout and navigation
• Optimization for current web browsers
• Basic page titles, descriptions, headings, and search-engine-friendly structure
• Connection of the Client's existing domain
• Contact forms delivered through a managed SMTP service
• Basic accessibility and performance considerations

The standard setup and redesign fee for this work is waived for the Client as a founding client, in consideration of the initial service commitment described in Section 9.

Managed Website Hosting (Recurring)

Ongoing service includes:

• Cloudflare-based website hosting
• SSL security certificate
• Content delivery and performance optimization
• Basic uptime monitoring
• Routine technical maintenance
• Troubleshooting of website-related problems
• Maintenance of the website's DNS configuration
• Reasonable restoration of the website following a hosting or deployment problem

The Client remains responsible for annual domain-registration charges and any separately purchased third-party services.

Domain & DNS Migration (One-Time)

Initial setup includes moving authoritative DNS management from Squarespace to Cloudflare, including:

• Reviewing and documenting the existing DNS configuration
• Recreating required website records
• Recreating existing email-related MX, SPF, DKIM, DMARC, verification, and related DNS records when present
• Updating the domain's nameservers
• Testing the website and email-related DNS configuration after the transition

This service does not replace or provide the Client's email mailbox service. Existing email accounts will continue to be provided by the Client's current email provider. The Client agrees to provide accurate account access and information about the current email provider before the DNS transition. Although reasonable precautions will be taken, availability of email and other third-party services remains dependent on those outside providers.

Contact Form Service

The website's contact form will be connected to a managed SMTP delivery service, including initial form setup, form-delivery configuration, basic spam protection, and troubleshooting when website form submissions are not being delivered properly.

The Package does not include management of the Client's regular email inboxes, password resets, employee mailbox setup, or general email technical support.

Google Business Profile Setup Assistance (One-Time)

One-time setup assistance includes:

• Checking for an existing Google Business Profile
• Helping create, claim, or request access to the appropriate profile
• Assistance entering the business name, phone number, website, hours, service area, categories, and basic service information
• Uploading a supplied logo, cover image, and basic business photos
• Guidance during Google's verification process
• Connecting the completed website to the Business Profile

The Client retains primary ownership of the Google Business Profile. Provider access should be granted through a manager invitation when ongoing assistance is needed. Google controls profile eligibility, verification, approval, visibility, and search placement; approval or any particular search ranking cannot be guaranteed.

Ongoing Google Business Profile posts, review responses, advertising, reputation management, and continual profile optimization are not included unless separately arranged.

Included Monthly Website Updates

The Package includes up to thirty (30) minutes of minor website updates per monthly billing period. Examples include: correcting text or typographical errors; updating hours, phone numbers, or contact information; replacing an existing image; adding or removing a testimonial; updating existing service descriptions; making minor price or staff-information changes; and updating an existing announcement or promotion.

Included time does not accumulate or carry forward between months. Routine requests will normally be completed within three (3) business days, depending on the size of the request and whether all required information has been supplied.

Additional Work

Work exceeding the included monthly update allowance will be discussed before billing. Additional work may be billed at $50 per additional 30-minute work block. Larger projects will receive a fixed quote when practical — for example: adding substantial new pages, redesigning an existing page, creating new forms or calculators, appointment or booking systems, customer portals, e-commerce features, custom integrations, new branding or logo design, extensive copywriting, or search advertising and social-media management.

No additional billable work will be performed without the Client's approval.

Fees, Billing & Service Term

• The service is billed automatically at $59 per month through Stripe. Prices are in U.S. dollars; any applicable taxes are additional.
• The first payment is due before the redesigned website is placed on the Client's primary domain.
• Because the initial redesign and setup fee has been waived, the Package has an initial six-month service commitment. After the initial six months, service continues month-to-month.
• The $59 founding-client rate remains in effect while the account remains continuously active and in good standing. If the account lapses or is canceled and later restarted, then-current rates may apply.
• After the initial term, the Client may cancel before the next billing date; cancellation becomes effective at the end of the current paid billing period. Partial-month refunds are not provided.
• If a recurring payment fails and is not resolved within a reasonable period after notice, services (including hosting) may be suspended until the account is brought current.

Ownership; Effect of Cancellation

The Client retains ownership of: the domain name; business name and branding; Client-supplied photographs; Client-supplied text and business information; the Google Business Profile; and existing email accounts.

Following completion of the initial six-month term, a copy of the current static website files may be provided upon request if service is canceled. Migration, modification, deployment, or configuration of those files with another website provider is not included and may be quoted separately.

Client Responsibilities

The Client agrees to:

• Maintain payment for the domain name and existing email service
• Provide accurate domain, email, and business information
• Provide necessary account access
• Review and approve the website before launch
• Participate in any identity or business-verification steps required by Google
• Confirm that submitted text, logos, and photographs may legally be used
• Promptly report website or contact-form problems

Third-Party Services

The services depend on third-party providers — including Stripe (payments), Cloudflare (hosting and DNS), Google (Business Profile and search), the managed SMTP provider (form delivery), and the Client's domain registrar and email provider. Those providers' terms, pricing, availability, and decisions are outside ByteBuilder's control, and ByteBuilder is not responsible for their actions, outages, or policy changes, though we will make reasonable efforts to work around and resolve third-party issues affecting the website.

Warranties & Limitation of Liability

ByteBuilder will perform the services with reasonable skill and care. Except as expressly stated, the services are provided "as available," and ByteBuilder disclaims all other warranties, express or implied, including fitness for a particular purpose and non-infringement. ByteBuilder does not warrant uninterrupted operation, specific search rankings, specific business results, or the conduct of third-party providers.

To the maximum extent permitted by law, ByteBuilder's total aggregate liability arising out of or related to the Package will not exceed the total fees paid by the Client in the six (6) months immediately preceding the event giving rise to the claim, and neither party will be liable for indirect, incidental, special, or consequential damages, including lost profits.

Governing Law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Florida.

Electronic Acceptance & Records

Enrollment in the recurring Stripe subscription and/or authorization to launch the website constitutes acceptance of the services, pricing, and conditions described in these terms. The parties agree that electronic records and electronic acceptance (including checkbox consent collected during Stripe checkout) are valid and enforceable, and that no handwritten signature is required. ByteBuilder retains the timestamped record of acceptance collected at checkout, and the version date above identifies the terms in effect at acceptance. A copy of these terms is available to the Client at any time on request and may be printed from this page.
